2. Nature of Services

2.1 Advisory Service

NZ European provides independent vehicle advisory services, including but not limited to:

• Consultation on European vehicle purchases
• Negotiation with authorized dealers on behalf of clients
• Presentation of competitive quotations
• Market analysis and recommendations

2.2 Independent Advisory

We operate as an independent advisor. We are not a vehicle dealer, manufacturer, or importer. We do not sell vehicles directly. All vehicle purchases are made directly between you and the dealer you choose to work with.

3. Client Obligations

3.1 Accurate Information

You agree to provide accurate, complete, and up-to-date information when using our services. Any inaccurate information may affect our ability to serve you effectively.

3.2 Serious Intent

Our services are designed for individuals with genuine intent to purchase a vehicle. You agree that your consultation request represents a serious enquiry.

3.3 Direct Communication

Once we facilitate an introduction to a dealer, you agree to conduct all subsequent negotiations and transactions directly with that dealer. We are not responsible for the terms, conditions, or performance of any agreement you enter into with a dealer.

4. Fees and Payment

4.1 Complimentary Consultation

Initial consultations are provided at no charge to you.

4.2 Dealer Compensation

If you complete a vehicle purchase through a dealer we introduce, that dealer may compensate NZ European. This compensation does not increase the price you pay and does not affect our independent advice.

4.3 No Hidden Fees

We do not charge clients directly for our standard advisory services. Any potential fees would be clearly communicated and agreed upon in writing before services are rendered.

5. Dealer Relationships

5.1 Third-Party Relationships

We maintain professional relationships with various European vehicle dealers in New Zealand. These relationships enable us to negotiate effectively on your behalf but do not constitute employment, partnership, or agency relationships.

5.2 Dealer Independence

Each dealer operates independently. We do not control dealer inventory, pricing, financing terms, delivery schedules, or after-sales service. All such matters are between you and the dealer.

5.3 Dealer Selection

We use our discretion to select appropriate dealers to approach based on your requirements. We work only with authorized dealers but do not endorse or guarantee any specific dealer's performance.

6. Limitation of Liability

6.1 Advisory Nature

Our services are advisory in nature. You acknowledge that all final decisions regarding vehicle purchases are made by you, and you accept full responsibility for those decisions.

6.2 No Warranty

We provide information and advice in good faith but make no warranties, express or implied, regarding:

• The accuracy or completeness of information provided
• Vehicle quality, condition, or suitability
• Dealer performance or reliability
• Market conditions or pricing trends

6.3 Maximum Liability

To the maximum extent permitted by law, our total liability to you for any claims arising from our services shall not exceed the amount of fees (if any) you have paid to us. We are not liable for any indirect, consequential, special, or punitive damages.

6.4 Vehicle Inspection

You are responsible for inspecting any vehicle before purchase, including arranging independent mechanical inspections if desired. We do not inspect vehicles on your behalf unless specifically agreed in writing.

7. Confidentiality

7.1 Client Information

We treat your personal information confidentially in accordance with our Privacy Policy. We will not disclose your identity to dealers without your consent.

7.2 Quotations

Dealer quotations obtained on your behalf are provided to you in confidence. You agree not to misuse this information or share it publicly in a manner that could harm dealer relationships.

8. Intellectual Property

All content on the NZ European website, including text, graphics, logos, and design elements, is the property of NZ European or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without written permission.

9. Website Use

9.1 Acceptable Use

You agree to use our website only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the website in any way that violates applicable laws or regulations
• Attempt to gain unauthorized access to our systems

14. Consumer Guarantees Act

Nothing in these Terms excludes, restricts, or modifies any consumer rights you may have under the Consumer Guarantees Act 1993 or other applicable consumer protection legislation in New Zealand.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and NZ European regarding our services and supersede all prior agreements or understandings.
